Terms and Conditions
1. SCOPE
The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or self-employed professional activity when concluding a legal transaction.
For entrepreneurs, the following applies: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they only become part of the contract if we have expressly agreed to them.
2. CONTRACT PARTNER, CONCLUSION OF CONTRACT, CORRECTION OPTIONS
The purchase contract is concluded with: cannmedic GmbH
By listing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.
3. CONTRACT LANGUAGE, STORAGE OF CONTRACT TEXT
The language available for concluding the contract: German
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. DELIVERY CONDITIONS
Shipping costs may be added to the stated product prices. Further details on any applicable shipping costs can be found in the offers.
5. PAYMENT
The following payment methods are generally available in our shop:
Advance payment
If you choose advance payment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.
Credit card
During the ordering process, you provide your credit card details. Your card will be charged immediately after placing the order.
PayPal
6. RIGHT OF WITHDRAWAL
Consumers generally have the statutory right of withdrawal. Exceptions apply to medical products that have already been shipped, as proper storage for the material medical products can no longer be guaranteed and the goods can no longer be sold by the seller. Entrepreneurs are not granted a voluntary right of withdrawal.
7. RETENTION OF TITLE
The goods remain our property until full payment has been made.
For entrepreneurs, the following applies additionally: We reserve ownership of the goods until all claims from an ongoing business relationship have been fully settled. You may resell the reserved goods in the ordinary course of business; all claims arising from this resale are assigned to us in advance up to the invoice amount – regardless of any connection or mixing of the reserved goods with a new item – and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you do not meet your payment obligations. We will release the securities to which we are entitled at your request to the extent that the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.
8. TRANSPORT DAMAGE
For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to report or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
9. WARRANTY AND GUARANTEES
9.1 Liability for defects
The statutory liability for defects applies.
9.2 Guarantees and customer service
Information on any additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.
10. DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board.
11. YOUTH PROTECTION
If your order includes goods subject to age restrictions, we ensure through a reliable procedure including personal identity and age verification that the purchaser has reached the required minimum age. The carrier will only hand over the goods after age verification and only to the purchaser personally. Delivery to parcel stations is not possible in this case.
12. FINAL PROVISIONS
If you are a merchant within the meaning of the Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business (Vienna).
